These Donor Terms of Service ("Terms") constitute a binding agreement between you and Stablish Giving Fund ("Stablish Giving Fund," "we," "us," or "our") and govern your use of our websites, subdomains, mobile applications, and related services that reference or link to these Terms, including the Stablish app.
By using our services or making a donation, you agree that:
If you do not agree, you may not use Stablish Giving Fund.
Stablish Giving Fund is recognized by the IRS as a tax-exempt public charity under Section 501(c)(3) (Federal Tax ID: xx-xxxxxxx).
We receive contributions and disburse them as grants to further charitable and educational purposes.
Grants are made only to organizations that qualify as IRS-recognized public charities under Section 509(a)(1) or (a)(2), or foreign charities that, in our discretion, are equivalent to U.S. public charities or conduct charitable programs that qualify under U.S. law.
We do not typically make grants directly to individuals, supporting organizations, or non-operating private foundations.
When you make a donation, you may recommend that we re-grant funds to a specific eligible charity.
By making such a recommendation, you certify that the grant will not:
IRS penalties may apply if recommendations confer improper benefits.
Stablish Giving Fund makes every effort to honor donor recommendations. However, recommendations are advisory only and not binding. By law, Stablish Giving Fund retains exclusive legal control over all donations and may redirect funds to a similar qualified charity if your recommendation cannot be fulfilled.
Donations are final and irrevocable gifts to Stablish Giving Fund in order to qualify as tax-deductible.
Refunds may only be issued in limited cases, in line with our Donation Refund Policy, and only if funds have not yet been re-granted.
You will receive a donation receipt from Stablish Giving Fund. Any acknowledgment from the benefiting charity is separate and not a tax receipt.
Some programs allow donors to contribute to a Donor Advised Fund ("Donor Account") with Stablish Giving Fund pending future recommendations. Donor Accounts are governed by our Donor Account Policy.
We collect and use donor data (name, email, mailing address if provided) in accordance with our Privacy Policy.
If you do not donate anonymously, we may share your information with enrolled charities that receive grants from your donation.
We do not share your information with unenrolled charities that have not agreed to handle data securely.
Stablish Giving Fund does not charge donors or charities for our grantmaking services. However:
Partners (such as payment processors or platforms) may deduct processing or platform fees from contributions according to their policies.
Such fees are outside of our control. Questions should be directed to the relevant partner.
You agree to indemnify and hold harmless Stablish Giving Fund, its affiliates, officers, directors, employees, service providers, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
To the fullest extent permitted by law, Stablish Giving Fund is not liable for any indirect, incidental, or consequential damages (including data loss), however arising.
You and Stablish Giving Fund agree to resolve disputes by final and binding arbitration (or small claims court where eligible), conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this Agreement.
No class, consolidated, or representative actions are permitted.
Relief may only be awarded on an individual basis.
If you are a new donor, you may opt out of arbitration by mailing a written notice within 30 days of first accepting these Terms (address provided below).

Stablish Giving Fund's financial statements are available online or upon request. Certain states require the following disclosures:
