Donor Account Policy
Last Updated: October 1, 2025
Welcome to the Stablish Giving Fund community. This policy explains how donations into Donor Accounts work and what rights and responsibilities both donors and Stablish Giving Fund have.
Stablish Giving Fund is recognized by the IRS as a tax-exempt public charity under Section 501(c)(3) of the Internal Revenue Code (Federal Tax ID: xx-xxxxxxxx). All donations made into Donor Accounts are considered final and irrevocable charitable gifts to Stablish Giving Fund and are governed by our Donor Terms of Service.
1. What Is a Donor Account?
A Donor Account is a donor advised fund at Stablish Giving Fund. Donors—whether individuals or corporations—make contributions into this account. Those contributions are then held securely until a donor (or their authorized advisor) recommends a grant to an eligible charity.
Receipts provided:
When you donate, you'll receive a date-stamped receipt for tax purposes.
Legal control:
As required by law, Stablish Giving Fund retains exclusive legal control over all donated funds.
Redirection if necessary:
If we are unable to fulfill your recommendation, funds may be redirected to a similar qualifying charity.
2. Secure Holding Until Delivery
Pending a recommended distribution, donations are kept in a secure, dedicated bank account. This ensures your contribution is safeguarded until it is granted.
3. Recommending a Charity
At the time of donation (or later), you may recommend a specific charity to receive your gift.
- You cannot recommend grants that exceed the balance in your Donor Account.
- For corporate Donor Accounts, the company must authorize in writing one or more individuals ("Authorized Individual(s)") to make recommendations on its behalf.
- Recommendations must be submitted in writing by the donor or Authorized Individual(s).
- All recommendations are subject to our Donor Terms of Service and our Donation Delivery Policy. While Stablish Giving Fund makes every effort to honor donor intent, recommendations are advisory, not binding.
4. How Grants Are Made
Unrestricted by default:
Grants are generally provided as unrestricted support so the charity can use the funds where most needed.
Restricted grants:
If you want funds used for a specific purpose, please confirm the recipient is able to honor this restriction before making the recommendation.
5. When Grants May Be Cancelled
Although rare, Stablish Giving Fund may cancel a grant recommendation if:
- The charity fails to meet our Nonprofit Certification Policy or due diligence standards.
- We cannot deliver the funds (e.g., check not cashed).
- The charity becomes ineligible under IRS rules.
In such cases, funds are returned to the Donor Account or reassigned according to our Donation Delivery Policy.
6. Timelines and Inactive Funds
Timely distribution:
We prioritize distributing funds as quickly as possible, consistent with our Donation Delivery Policy.
Minimum activity:
At least 5% of funds in each Donor Account should be recommended for distribution each year.
No recommendations for 12 months:
We may request that you make a recommendation to keep the account active.
No recommendations for 36 months:
The account will be considered inactive, and remaining funds may be redirected by Stablish Giving Fund to eligible charities.
7. Switching or Closing Accounts
- All donations to Stablish Giving Fund are final and irrevocable.
- In limited cases, donors may recommend transferring the entire balance of a Donor Account to another donor advised fund, provided that fund meets our certification standards.
Summary
- All contributions are final charitable gifts to Stablish Giving Fund.
- Donor recommendations are valued but advisory only.
- Stablish Giving Fund retains legal control over donated funds, ensuring compliance with IRS law.
- Funds are safeguarded until granted, with strong protections against loss or misuse.
